Changes in the employment of Colombian citizens in Poland from August 15, 2024

On August 15, 2024, amendments to the legislation concerning the employment of Colombian citizens came into force in Poland. Previously, Colombians could enter Poland under the visa-free regime, obtain a work permit (zezwolenie) on the spot and start working. However, the new rules require Colombian nationals to obtain a work visa before coming to Poland.
Preliminary employment procedure:
- Visa-free entry: Colombian citizens could enter Poland without a visa for tourist purposes.
- Obtaining a work permit: Upon arrival, they could apply to the relevant authorities for a work permit (zezwolenie).
- Starting work: After obtaining the permit, they could legally work in Poland.
- Work on a work visa: Finding an employer, obtaining a work permit, opening a Polish work visa at the Consulate of the Republic of Poland in Colombia or another country, and coming to work in Poland.
The new employment procedure from August 15, 2024:
- Obtaining a work permit (zezwolenie): A Colombian citizen planning to work in Poland must first find an employer willing to provide him/her with a job. The employer is obliged to apply for a work permit for the foreigner.
- Submitting documents for an employment visa: After obtaining a work permit, the foreigner must apply to the Polish consulate in Colombia or another country where he or she is legally residing for a work visa.
- Obtaining a work visa: After reviewing the application and confirming all the necessary documents, a work visa is issued, which allows entry to Poland for the purpose of employment.
- Entering Poland and starting work: With a work visa, a Colombian citizen can enter Poland and start working in accordance with the conditions specified in the work permit.
Reasons for the changes:
The changes in legislation are aimed at strengthening control over the labor market and ensuring legal employment of foreigners. They are intended to prevent illegal work and guarantee the observance of labor rights of both employees and employers.
Recommendations for Colombian citizens:
- Planning: Plan the employment process in advance, taking into account the need to obtain a work permit and work visa.
- Consultation: Contact Polish consular offices for detailed information on procedures and required documents.
- Compliance with the law: Strictly follow the new rules to avoid possible legal problems and ensure legal stay and work in Poland.
Changes in the legislation require Colombian citizens to be more thoroughly prepared before employment in Poland. Compliance with the new procedures will facilitate legal and safe employment in the country.
